Clearly such laws are in violation of the 'establishment of religion' clause of the Constitution since they attempt to establish a singular religious belief as law.

but I guess until someone claims harm and actually sues, there can be no test - they just create fear and intimidation.

Thank you Jessica for highlighting these issues. I couldn't help but think of "A Handmaiden's Tale." I also couldn't help but wonder how this law must cause infertile couples in Louisiana great pause before seeking treatment. Yes, there are important moral considerations that need attention, but preimplanted embryos do not require the same moral considerations as children.

Don't expect things to get better, now that the fine citizens of North Louisiana have elected Jindal as our governor.

New Orleans should secede from the rest of the state.

A fine analysis of one state's "embryo legislation" with troublesome consequences for stem cell research. Further comment on Louisiana and other state law, along with a discussion of the realities of "embryo adoption" can be found at www.thestemcellblog.com.

Jessica - thank you for this excellent article. I hadn't heard about this law and find it very distressing. I wonder what your thoughts are about how this law might bump up against the use of preimplantation genetic diagnosis? Are these sort of testing applications also analyzed in terms of " best interest of embryo"? Can we imagine a day where someone might argue embryos with certain genetic mutations are covered under the ADA, or is that too far - fetched?
